Georgian Law No. 1888-VIმს-XIმპ of 15 October 2026, in force from 16 October 2026, amends Article 309 (paragraphs 79 and 81²) of the Tax Code of Georgia, extending the period of VAT exemption with the right of deduction for supplies of immovable property and related construction and installation services from 1 January 2029 to 1 January 2033.
What changed in detail
The Parliament of Georgia adopted Law No. 1888-VIმს-XIმპ “On Amendments to the Tax Code of Georgia” on 15 October 2026. It was published on the Legislative Herald website on 16 October 2026 and, under its Article 2, entered into force on publication.
Article 1 amends Article 309 of the Tax Code, the transitional provisions:
- Paragraph 79(a) now covers supplies of immovable property and related construction and installation services made in the period from 1 January 2015 to 1 January 2033.
- Paragraph 79(d) now requires the competent authority to issue the individual administrative act putting the building into operation before 1 January 2033.
- Paragraph 81² is restated. It sets the statute-of-limitation period for exempt operations under paragraphs 79 and 80 by reporting period, running from 18 years for 2015 down to 4 years for reporting periods from 1 January 2029 to 1 January 2030.
Per the frozen fact, the amendment extends the end of the exemption-with-credit period from 1 January 2029 to 1 January 2033.
What it means
Developers that rely on the Article 309(79) relief gain four more years to complete supplies and obtain the commissioning act. Both conditions now run to 1 January 2033, so a project that would have missed the 2029 cut-off can stay inside the exemption. Tax engines and contract templates that hard-code the 2029 date need updating. The restated limitation table in paragraph 81² still lists reporting periods only up to 1 January 2030, so check how audit exposure is counted for later periods.
